We, the dawin gmbh, are pleased about your interest in our „spicture“ App. One of our most important concerns is the protection of your personal rights. The collection, processing and use of your personal data will only be done exclusively in accordance with the applicable data protection regulations of the Federal Data Protection Act (BDSG) and the Telemedia Act (TMA). We will not use your personal data without your consent for any purposes other than those stated in and resulting from the connection with this Privacy Statement. This statement may at any time be retrieved, stored and printed out at the URL www.spicture-app.de. The following is an explanation of what data we collect at what time, for what purpose and how it is processed and used.
Collection, processing and use of personal data
With the installation of the „spicture“ App certain data, necessary for the implementation of the App, will be collected and processed. This is the data that you agreed to have collected, to the extent you have given appropriate permissions on your end-device (such as e.g. camera, photos, microphone, GPS data, contact data) to the respective App Store operators (Google Play or Apple App-Store).
Once you have loaded the App onto your smartphone, you have the option of taking a photograph or to select a photograph from your pictures library. Furthermore, you are able to modify the selected photograph with drawings, as well as create text input, sketches and sound recordings, which will then be allocated to the selected photograph. When you call up the dictation function of your smartphone, you will be transmitting your voice recordings to the web service of the respective OS manufacturer, i.e. Apple, Google or Microsoft, which will then transcribe the recordings into text. All texts, sound files, sketches and other information (e.g. date, GPS data) are stored on your smartphone, together with your photograph, and can be forwarded from there as a .pdf- or .xlsx or Zip-file using your email accounts.
dawin gmbh will not store any data permanently. Concerning the data you supplied to us for processing (especially for transmitting), this is done only for reasons you expressly or voluntary provided to us.
Disclosure of personal data
For the transcription of audio recordings we use web services provided by the respective OS vendors, Apple or Google. Using this functionality, your data will be transmitted to the servers of the aforementioned companies, which could be located outside of the European Union, particularly in the USA.
We will employ the web services of the respective OS-manufacturers Apple or Google for the transcription of audio recordings. Should you not be comfortable with the transmission of your data to these OS-manufacturers, you can stop the transfer of your data by deactivating the software in your local settings for SIRI (Apple) or Google Now (Google).
Moreover, personal data will not be forwarded without your express consent, unless we are obligated by law to surrender data (information to law enforcement authorities and courts; information to public authorities, who will receive the data for compliance with the law, e.g. (German) social insurance carriers, tax authorities, etc. ) or so that we may contract third parties, bound by professional confidentiality laws, to enforce demands we may have.
Disclosure of technical data
We safeguard our systems by means of technical and organisational measures against loss, destruction, access, modifications or distribution of your data to unauthorised parties. Despite regular monitoring, complete protection against all risks may not be possible.
The App does use encryption in some places, which conform to industry standards SSL (Secure Sockets Layer). This guarantees the confidentiality of your personal data during transmission via the Internet.
Notice of changes
Legislative amendments or changes to our internal processes can require an adaptation of this Privacy Statement. In the event of such a change, we will give you the information via an update of the software and this privacy statement.
As a rule, you are entitled to withdraw your initial consent. Please note that (if you do not make use of your right to withdraw consent) the current version of the Privacy Statement will be valid.
Updating / deleting your personal data
You do, at any time have the option of reviewing the personal data you provided to us, to amend or even delete them, by sending an email to us at firstname.lastname@example.org.
You are also, at any time, entitled to revoke your consent effective for future use.
Deletion of the stored personal data takes place as soon as you withdraw your consent for storage, or when knowledge of this stored data is no longer required for the fulfilment of its initial storing purpose. Deletion of the data will take place after the expiry of time limits as mandated in the tax and commercial laws.
Right to information
You have a right to free information about your stored data and, if necessary, a right to rectification, blocking or deletion of this data.
